This preliminary study was created in preparation for the Consumer Research Forum Baden-Württemberg 2021 (VFF 2021). It does not claim to be complete, but it presents a sketch of the status quo of applied behavior-based instruments in consumer policy with a focus on Germany and Europe. The VFF 2021 wants to take up and deepen the intensive discussion of behavior-based consumer policy. In August 2021, the fundamental work 'Nudge' by Richard Thaler and Cass Sunstein (2008) will be published in a revised second edition. This is an occasion to join one of the authors to consider the possibilities and challenges of taking behavioral science findings into account for consumer policy in the federal and state levels on the basis of today's evidence and experience, and to assess their contribution.
